The answer is simple. Quebec business and Quebec law are different than in the rest of Canada.

The language barrier is one major difference. Even the differences between French from France and Canadian French are as significant as the differences between English from England and American/Canadian English.

  • Based on the Napoleonic Civil Code, the Quebec Civil Code regulates all contracts and business transactions in Quebec. Common Law is for the rest of Canada.
  • All collection agencies operating in Quebec must have an active branch and an open office in the province and must have a permit from the Office de la protection du consommateur.
  • Collection agencies in Quebec are governed by law and subject to regulation.
  • Quebec law stipulates that all amounts recovered by collection agencies must be deposited in a trust account

If legal action becomes necessary in the province of Quebec clients should be aware of the following:
  • You have recourse to small claims court only as an individual or as a small company with less than 5 employees and when the amount in question is less than $7,000.  Furthermore, you do not qualify if you have attained the 5 employees or more benchmark in the last 12 months of operations.
  • In small claims court claimants must represent themselves in court at their own expense.  The claimant may not be represented by any third party whatsoever.

By working with us from the beginning of the claims process you place yourself in an excellent position should the matter ever get as far as legal action.
